On that day, in-store counterfeit fraud liability will shift to the party -- either the issuing financial institution or the merchant -- that has not adopted chip technology. Understanding how this liability shift affects your business can help protect you from liability exposure. If a business accepts and processes a counterfeit card transaction on a non-EMV terminal, the business may be responsible for incurred fraud losses -- NOT the card issuer -- up to $5,000 per card per customer that is impacted.
